Legal Guarantee of Conformity

All products purchased from our website by consumers are covered by the
legal guarantee of conformity provided for under applicable consumer protection law.
For new goods, the legal guarantee applies for a period of
2 years from the date of delivery of the product.
The legal guarantee covers lack of conformity existing at the time the
product was delivered and which becomes apparent within the period provided for by law.
The 2-year period does not constitute a period during which the product
may be freely returned for any reason, nor does it constitute a guarantee
against any form of deterioration, wear or damage that may occur during use.
What the legal guarantee covers
A product may be considered not to conform to the contract when, for example:
- it does not correspond to the description or characteristics stated at the time of purchase;
- it has a manufacturing defect;
- it does not have the characteristics that a consumer may reasonably expect from goods of the same type, taking into account the nature of the product and the information provided at the time of sale;
- it is not fit for the purposes for which goods of the same type would normally be used.
The occurrence of an issue within the 2-year period
does not automatically mean that the product has a lack of conformity.
The nature and cause of the issue must be assessed in accordance with applicable law.
Normal wear, plating and changes in the appearance of jewellery
Jewellery is naturally subject to wear and may undergo changes in appearance
over time as a result of use, the characteristics of the materials and the way
in which the product is stored and cared for.
The legal guarantee does not cover deterioration occurring after delivery
as a result of normal use, improper use or incorrect or inadequate care,
where such deterioration does not result from a lack of conformity that existed
at the time of delivery.
By way of example, the following do not automatically constitute a lack of conformity:
- gradual deterioration or wearing of the plating resulting from normal wear and use;
- surface alterations resulting from contact with water, perfumes, cosmetics, creams, detergents or other chemical substances;
- alterations resulting from perspiration, individual skin pH or prolonged exposure to moisture;
- oxidation or surface changes consistent with the characteristics of the material and the conditions in which the product has been used;
- scratches, abrasions, impacts, deformation or breakage caused during use;
- loss of or damage to components resulting from impacts, pulling, accidental damage or improper use;
- damage resulting from failure to follow the care and storage instructions supplied with the product or published on our website.
These circumstances will nevertheless be assessed on a case-by-case basis,
as the legal guarantee will continue to apply where the issue is attributable
to a lack of conformity that existed at the time of delivery.
How to care for your jewellery
To help preserve the original appearance of your jewellery for as long as possible,
we recommend that you:
- avoid direct contact with perfumes, cosmetics, creams, detergents and chemical products;
- remove your jewellery before showering or bathing;
- remove your jewellery before swimming in a pool or in the sea;
- avoid wearing it during sports or other activities that may expose it to excessive perspiration, impacts or abrasion;
- avoid prolonged exposure to moisture;
- store your jewellery in a dry place and, preferably, separately from other jewellery.
Normal wear and tear of the product over time does not, in itself,
constitute a lack of conformity.
What happens in the event of a lack of conformity
Where a lack of conformity covered by the legal guarantee is established,
the consumer is entitled to the remedies provided for under applicable law.
In the first instance, the consumer may request that the goods be brought into
conformity by means of repair or replacement, free of charge,
in the circumstances and subject to the conditions provided for by law.
Where the conditions established by applicable law are met, the consumer may
also be entitled to a proportionate reduction in the price or termination
of the contract.
The legal guarantee therefore does not automatically entitle the consumer
to a full refund for any issue that may arise during the 2-year period.
Burden of proof
Unless proven otherwise and subject to the conditions provided for by applicable
law, a lack of conformity which becomes apparent
within one year of delivery is presumed to have existed at the
time of delivery, unless this presumption is incompatible with the nature of the
goods or the nature of the lack of conformity.
Where the lack of conformity becomes apparent after the first year,
the consumer must demonstrate that the lack of conformity already existed at the
time of delivery, in accordance with applicable law.
How to report a possible lack of conformity
To request assistance under the legal guarantee, please contact our Customer
Service team at gadget4entertainmentsas@gmail.com and provide:
- your order number;
- the product concerned;
- a description of the issue;
- where useful for assessing the request, photographs clearly showing the issue.
We may request that the product be returned where an examination is necessary
to determine the nature and cause of the issue.
Any request for photographs or for examination of the product is made solely
for the purpose of assessing and handling the claim and
does not limit any rights granted to consumers under applicable law.
The legal guarantee and the right of withdrawal are different rights
The 2-year legal guarantee should not be confused with the
right of withdrawal applicable to online purchases.
The right of withdrawal allows consumers, where provided for by law, to notify
us of their decision to withdraw from an online purchase within
14 days, without having to provide a reason.
The legal guarantee, on the other hand, concerns a
lack of conformity of the product and is subject to different rules.
In summary: the 14-day period concerns the consumer's right to change
their mind about an online purchase, while the 2-year period concerns the legal
guarantee of conformity and does not constitute a general right to return a
product for any reason within two years.
